Wendy R.: Man held at Golden State Annex without bond hearing, court rules

A man held at Golden State Annex after being paroled into the U.S. and later taken back into custody was ordered released when a judge found no urgent reason justified holding him without a hearing.

A man who had been paroled into the United States was later re-detained by immigration authorities and held at the Golden State Annex Detention Facility. The government argued he was subject to mandatory detention law, but acknowledged his case fit the pattern of similar cases where courts in the district had found such detention improper without a hearing. The court found no urgent circumstances justified detaining him before giving him a chance to contest it. The judge ruled that due process required a bond hearing before his detention, which never happened. As a result, the court granted his habeas petition, ordered his immediate release, and barred authorities from re-detaining him unless they prove by clear and convincing evidence at a hearing that he is a flight risk or danger to the community.
