A man who had been paroled into the United States by immigration authorities on December 4, 2023, was living under that status until June 7, 2025, when he was re-detained by ICE and held at the California City Detention Center. He was given no notice and no hearing before being taken back into custody, despite his earlier release having created a liberty interest in his continued freedom. He filed a habeas petition from detention seeking his immediate release, along with emergency motions for a temporary restraining order and appointed counsel. The government conceded that his case was not legally distinguishable from other cases in which the court had already ordered release under similar circumstances. The federal judge granted the habeas petition, ordering his immediate release under the same conditions he had before his re-detention, and barred the government from detaining him again without first providing notice and a hearing before an immigration judge.
