A Guatemalan man has lived in the United States since entering in May 2007. In August 2026, he was taken into ICE custody during a traffic stop that involved another immigrant, and he was held at the California City Immigration Processing Center. He was never given an individualized custody determination or the opportunity to show he was not a flight risk or danger, as required by law for people detained under this part of immigration statute. A federal judge found that this failure alone violated his due process rights and ordered his immediate release, also barring ICE from re-detaining him without first providing notice and a hearing before an immigration judge.
