Sep 19, 2026Fresno, CACountry of origin: India

An Indian asylum seeker who entered the United States in May 2023 and was released into the community on his own recognizance under an alternatives-to-detention program. He applied for asylum, which remains pending, and was approved for work authorization, remaining steadily employed with no criminal history. On September 19, 2026, ICE directed him to appear for an unscheduled appointment, and when he reported to the Fresno Enforcement and Removal Operations office as instructed, he was arrested. ICE claimed he had missed several biometric check-ins and a home visit, but he disputed this, stating he complied with reporting requirements and was repeatedly told by ICE officers that his submissions had been received. He was transferred to the Golden State Annex Facility in McFarland, California, where he remained detained. A federal judge found the government failed to provide reliable, independent evidence of the alleged violations and that his arrest appeared pretextual, ruling that his re-detention after three years without a hearing violated due process. The court granted his habeas petition and ordered his immediate release.
