Edmin D.: Man held at California City center wins bond hearing after parole lapsed

A man who had been paroled into the United States was re-detained after his parole expired in December 2023. A federal judge ruled his continued detention without a bond hearing violated due process and ordered a hearing within 14 days.

A man was previously paroled into the United States but was re-detained by immigration authorities after his parole expired in December 2023. He is currently held at the California City Immigration Processing Center. The government argued his detention was mandatory under federal law because his parole had lapsed. A federal judge disagreed, finding that due process requires a bond hearing whenever someone who had been paroled into the country is later re-detained. The court granted his petition for habeas corpus and ordered the government to provide him with a bond hearing before a neutral decisionmaker within fourteen days, with the government bearing the burden of proving he is a flight risk or danger to the community. If no hearing is held within that time, he must be released.
