Nazim Y.: Turkish asylum seeker re-detained by ICE without any hearing

A Turkish asylum seeker who has worked legally since 2023, with no criminal history, was re-arrested at home and detained for weeks until a judge ordered his immediate release.

Aug 4, 2026McFarland, CACountry of origin: Turkey

A Turkish asylum seeker came to the United States in May 2023 and was released into the interior after being encountered by immigration authorities. He filed an application for asylum, which remains pending, and was approved for work authorization. He has no criminal history. In August 2026, deportation officers located him at his last known address and arrested him under an administrative warrant for immigration violations, then transferred him to the Golden State Annex Detention Facility in McFarland, California, where he remained detained for weeks. When he sought a bond hearing before an immigration judge, the court said it lacked jurisdiction to consider bond. A federal judge found the government's justification for mandatory detention had been repeatedly rejected by the court, ruled his re-detention without a hearing violated his due process rights, and ordered his immediate release along with protections against future re-detention without notice and a bond hearing.
