Malkeet S.: Indian asylum seeker's re-detention ruled unconstitutional

An Indian asylum seeker, re-arrested in July 2026 after being released years earlier, had a judge rule his renewed detention unconstitutional for violating due process.

Sep 25, 2026California City, CACountry of origin: India

A citizen of India entered the United States through the Mexico border in 2022 and was released after an initial encounter with immigration authorities. He later applied for asylum, but on July 17, 2026, officials arrested him again under a newly issued warrant and notice to appear, holding him at the Golden State Annex Immigration Processing Center. He filed a habeas corpus petition and a motion for a temporary restraining order seeking his release. A federal judge found that his re-detention without a prior custody hearing violated due process because he had developed a liberty interest in his continued freedom after his earlier release.
