Yordy V.L.: Cuban man re-detained by ICE after license-related court absence

A Cuban man who held work authorization after entering on humanitarian parole was redetained without a hearing; a court called it unconstitutional and ordered him a bond hearing within 14 days.

Aug 29, 2026Brooksville, FLCountry of origin: Cuba

A Cuban man entered the United States in June 2023 and was released on Cuban Humanitarian Parole, later obtaining work authorization that expired in June 2025. In August 2026, local police in Florida arrested him on a misdemeanor charge for failing to appear in court on a suspended license offense, and he was booked into Hernando County Jail. ICE lodged a detainer and then took him into custody, transferring him to the Golden State Annex Facility in McFarland, California, where he has remained. DHS issued a Notice to Appear charging him as removable, and his removal case is still pending with no final order issued. He filed a habeas petition arguing his re-detention without any hearing violated his due process rights. The court agreed that detaining him without a pre-deprivation hearing was unconstitutional, rejecting the government's claim that his detention was mandatory, and ordered that he receive an individualized bond hearing within 14 days where the government must prove by clear and convincing evidence that he is a danger or flight risk.
